H1 bread crumbs bad for SEO? earn by blogging adsense income

A site I work with uses an h1 tag for the bread crumb navigation on product pages. The product name also has an h1 tag, but lower down the page. I'm not wild about having multiple h1 tags on a single page, but I need a little more if I'm going to build a case for the development team to change the style. Could this have a negative effect on our SEO or am I just being captious?
