Help with competitor misusing schema markup. earn by blogging adsense income

Have a competitor who has occasionally popped up as a single result return for our dominant keyword. Let's say it's "plumbing Melbourne".

It overwrites the map result and a the ads as well. I have looked into them a little and it seems that they have done some interesting things. On the bottom of the page they have "(c) plumbing Melbourne" and their schema markup has their business name listed as "plumbing Melbourne". They don't have this registered as a company or trading name.

Is this trick giving them that result and are they likely to be penalised? Is there a way to report misuse of schema?
